Terms and Conditions of Sale
These terms set out the conditions under which we supply our products to you. Please read them carefully before placing an order. They explain what you need to know about shopping with us. We may update these terms at any time without notice by posting the revised version on our website. The version displayed on our website or app at the time you place your order will apply to that purchase.
1. Who We Are and How to Contact Us
1.1 Who we are. We are Gentle Fields, a Private Limited company incorporated in Singapore.

1.3 How we contact you. If we need to get in touch, we will use the email address you provided with your most recent order.
2. Placing an Order
2.1 How to order. Orders may be placed through our website or app. Once you’ve added items to your basket, you’ll proceed through checkout, where you’ll enter your contact, delivery, and billing information. Please carefully review all order details (including products, sizes, and delivery address) before clicking “complete order” or “pay now” (if paying via Apple Pay).
2.2 Order acceptance. Your order is an offer to purchase. We will acknowledge receipt by email, but acceptance occurs in Singapore once we email you confirming that your order has been dispatched. At that point, a contract is formed. You’ll also receive an order number, which you should reference when contacting us about your order.
2.3 Age and payment restrictions. You must be at least 18 years old and authorized to use the chosen payment method. If you are under 18, you may only order with the involvement of a parent or guardian.
3. Our Rights to Cancel Your Order
3.1 If we cannot fulfill your order. If we are unable to complete your order (e.g., product out of stock, billing information cannot be verified, delivery requested to a non-eligible country, or an error in pricing/description), we’ll notify you by email and you will not be charged.
3.2 Suspicious or unusual activity. Our products are intended for personal use only. We may cancel orders that appear to be for commercial, business, or resale purposes. If you believe this is an error, contact our customer service team at [contact].
3.3 Suspension of supply. We may temporarily suspend supply in order to:

resolve technical issues or make minor technical updates;

comply with new legal or regulatory requirements; or
-
make notified changes to the product.
4. Our Products
4.1 What we sell. We supply cushions.
4.2 Product descriptions. Images of products (and packaging) on our website/app are for illustration. We aim to display colors accurately, but cannot guarantee exact matches with your device’s display.
4.3 Gift cards. Digital gift cards may be purchased like any other product, but:

they cannot be bought using another gift card;
-
purchases are limited to $2,000 per person per day;
-
they do not expire;
-
balances do not decrease over time; and
-
they may only be redeemed on the same local online store/app where purchased.
5. Delivery
5.1 Delivery area. We ship orders placed on our website to the United States.
5.2 Risk and title. Risk of loss passes to you when we hand products to the carrier. Ownership transfers upon payment.

5.4 Delivery times. Timing depends on the method chosen at checkout. Promotional periods may cause slight delays.
5.5 Delays beyond our control. If delivery is delayed due to events outside our control (e.g., courier delays, logistics issues, weather), we’ll notify you. If the delay is substantial, you may cancel for a full refund.
5.6 If you’re not available. If no one can accept delivery and the order cannot be left, the courier will notify you with instructions to rearrange delivery or collection.
6. Your Rights
6.1 Faulty or misdescribed products. If your product is faulty or significantly different from its description, you may be entitled to a replacement or refund. Returns are free within the US if made within 30 days (unless otherwise stated online).
6.2 Ending the contract for our fault. You may cancel immediately, with a full refund for undelivered products, if:

we notify you of a product/terms change you do not accept;
-
we inform you of a pricing/description error;
-
supply is significantly delayed due to factors outside our control;
-
products are suspended for technical reasons for over four weeks; or
-
we otherwise breach the contract.
6.3 Changing your mind (goodwill policy). You may return products within 30 days (unless otherwise stated) after delivery. If items are delivered in multiple shipments, the period runs from the last delivery. You must pay return costs. Some products cannot be returned, including:

custom-made/personalized goods;
-
products with care labels removed;
-
items missing parts (unless our fault);
-
goods inseparably mixed with others after delivery;
-
items marked as final sale.
6.4 Ending before delivery. You may cancel before dispatch, even if you have no legal right or goodwill basis, by notifying us.
7. Returns and Refunds
7.1 How to end the contract. Contact our customer service team at hello@gentlefields.com or through our app/website support options. Provide your name, delivery address, order number, and email.
7.2 Returning items. Follow our Returns Policy via the Returns Portal [link]. Enter return details, print a label if required, and drop the package at an identified collection point. Unless otherwise stated, returns must reach us within 30 days. We may refuse returns/exchanges at our discretion.
7.3 Refunds. Refunds (including applicable delivery costs) will be made by your original payment method. For part-card, part-gift card payments, refunds go to the gift card first. Discount code refunds reflect the discounted amount. Refunds are issued within 14 days of us receiving the unused product.
8. Our Rights to End the Contract
8.1 If you break the contract. We may end the contract if you fail to provide necessary information (e.g., delivery address) or do not allow delivery.
8.2 Refunds. If we end the contract under 8.1, you will be refunded for any products not supplied.
9. Price and Payment
9.1 Product prices. Prices shown before checkout exclude Sales Tax. Final tax is calculated at checkout based on delivery address.
9.2 Price changes. We may update prices from time to time. Orders placed before changes remain at the earlier price.
9.3 Errors. If a product is incorrectly priced and the error is obvious, we may cancel the order, refund you, and require product return.
9.4 Payment. Accepted methods: Visa, Mastercard, American Express, PayPal, and Apple Pay. We only charge once your order is dispatched, though pending charges may appear earlier.
10. Discount Codes
10.1 Issuing codes. Codes may be distributed via email or other marketing channels and must be entered at checkout.
10.2 Rules.

Codes are valid only for the period specified.

Unless otherwise stated, they apply only to full-priced items, not sale/outlet/promotional products or gift cards.

Only one Code may be used per order.

Codes cannot be combined, transferred, exchanged for cash, or applied to delivery charges.

Staff of Gentle Fields and affiliates may not use Codes.

Refunds for discounted items reflect the reduced price. Returning items may reduce qualifying spend, which may reduce refund value.

Orders are subject to stock availability and acceptance. Improper or fraudulent use may lead to rejection.

We may withdraw, amend, or extend offers with reasonable notice.
10.3 Specific offer conditions. Additional terms will be included with each Code.
11. Responsibility for Loss or Damage
11.1 Foreseeable losses. We are liable only for foreseeable losses caused by breach or negligence.
11.2 No liability for unforeseeable losses. We are not responsible for indirect, incidental, or consequential damages, including lost profits or data.
11.3 Liability cap. Our liability to you is capped at US$100.
11.4 Unlawful exclusions. We do not exclude liability for death, injury caused by negligence, fraud, misrepresentation, statutory rights, or defective products under applicable law. Some jurisdictions may override these limits.
11.5 Business use. Products are for personal use. We accept no liability for business-related losses.
12. Use of Personal Information
We will use your personal information only in line with our Privacy Notice: [link].
13. Other Important Terms
13.1 Transfer by us. We may transfer rights and obligations under this contract to another entity. You may cancel within seven days if you object.
13.2 Transfer by you. You may only transfer your rights/obligations with our written consent.
13.3 Third-party rights. Only you and we have rights under this contract.
13.4 Changes to terms. We may update these terms at any time. Always review the current version on our website/app before ordering.
13.5 Severability. If a court finds part of these terms unlawful, the rest remains effective.
13.6 Delays in enforcement. Failure to enforce any right immediately does not waive our right to enforce later.
13.7 Governing law. These terms are governed by English law. The UN Convention on Contracts for the International Sale of Goods does not apply.
14. Arbitration; Waiver of Class Action
14.1 US customers. If you live in the United States, any disputes relating to our products or Sites (including website, app, social media, or other channels) must be resolved exclusively through final and binding arbitration by the American Arbitration Association (AAA).
14.2 Pre-arbitration notice. You must first notify us in writing and allow 30 days for resolution before demanding arbitration.
14.3 Arbitration process.

Single arbitrator, under AAA rules, governed by the Federal Arbitration Act.

For claims ≤$10,000: conducted via phone or written submissions, arbitrator fees paid by us (unless frivolous).

For claims >$10,000: in-person arbitration, fees split equally.

Arbitrators may award actual direct damages only; no punitive, equitable, or special damages.

No right to court or jury trial.

Claims must be individual, not class or collective. Arbitrators may only resolve disputes between you and us.

If clause (class arbitration waiver) is invalidated, claims must go to court, not arbitration.
14.4 Opt-out. You may opt out of arbitration by sending written notice to [contact] within 30

days of first use of the Sites or any changes to this section.
14.5 Effect of opt-out. If you opt out, neither you nor Gentle Fields are bound by arbitration. If you do not, use of the Sites will be considered acceptance.
14.6 Severability. If any clause of this arbitration section is unenforceable, the remainder stays in force.
15. Class Action Waiver
15.1 No class actions. You and Gentle Fields agree to resolve disputes individually, not as part of any class, consolidated, or representative proceeding.
15.2 Scope. This waiver also applies to claims against Gentle Fields affiliates if related to your use of the Sites or services.
